How can you act as guarantor for a foreigner?
It is possible to act as a guarantor for someone from abroad Proof of guarantee and/or private accommodation form. With the sponsor statement you let the authorities in the Netherlands know that you guarantee the costs of a foreign national's stay in the Netherlands. You also guarantee that this person will leave the Netherlands on time. The guarantee statement states exactly what this means for you:
"I (the undersigned) hereby declare that I guarantee the payment of the costs of the stay, medical care and repatriation caused by the person mentioned under 4. for a period of 5 years or as much shorter as the stay of the counting from the entry of that person into the Schengen territory, up to a maximum of € 10.000 per year, insofar as these costs would otherwise be borne by the State and/or public bodies. The guarantee ends when it can be adequately demonstrated that the person referred to under 4. has left the Schengen area (such as an exit stamp affixed by a Schengen state or an entry stamp affixed by an authority responsible for border control in the country of origin)."
What are the conditions to guarantee?
To guarantee a foreign visitor, your income must be at least equal to the minimum wage (excluding holiday pay). Couples have a joint income of at least the minimum wage (excluding holiday pay). You must fill in a proof of guarantee and/or private accommodation and have your signature legalized by the municipality. If you are married or living together, your partner must also sign for the guarantee.
In principle, you can guarantee a maximum of 2 adults (+ possibly 1 or 2 children) at the same time. You must use a separate 'Proof of guarantee and/or accommodation' form for each person. You must also have your signature legalized for each form. It is ultimately up to the Dutch representation or Consular Service Organization (CSO) to judge whether and for how many persons someone can act as guarantor at the same time.
How can you guarantee?
- First, you fill in the proof of guarantee and/or private accommodation form. If you want to act as guarantor for several people, you must also fill in the form several times.
- Have your signature on the form legalized at your municipality. The warranty is valid for 6 months.
- Collect the additional documents (see below). Send this together with the form to the visitor abroad.
- Your foreign visitor can apply for a visa at the Dutch embassy (or consulate) or the service office of the external service provider abroad after receiving the forms. Remember that a copy of the guarantee must always be taken with you during the trip. The Royal Netherlands Marechaussee can ask for this form at the border control at the airport. The lack of this form can be a reason to refuse entry to the Netherlands.
Which documents and evidence are required for guarantee
Next to the form proof of sponsorship and/or private accommodation documents must also be sent along that prove that you have sufficient income to act as guarantor. You also send this to the foreign visitor.
You are a guarantor and are employed:
- a copy of your employment contract (this must be valid for at least 12 months from the time of the visa application);
- a copy of your last 3 pay slips.
