Objecting and appealing against a visa rejection
You have a decision upon you short stay visa application received. The request has been rejected. You can then object to this. If the objection does not yield results, you can appeal.
Steps in the appeal process
Making an objection consists of a number of steps:
1. Submit an appeal
You object by mail objection submit. There is one for every request specific period within which you can object. Make sure you object in time. You enclose a copy of the decision with your letter. You may also send other documents. For example, documents explaining why you disagree with the decision. Send your notice of objection to the address in the decision.
You can object yourself. Can't do this? Then someone else can also object for you. These persons can object on your behalf:
- your legal representative;
- a special authorized representative;
- a lawyer;
- the employer who is your sponsor;
- the family member who is your sponsor (the partner or parent with whom you are staying).

2. Receipt and verification of notice of objection
When the IND receives your notice of objection, you or your lawyer will receive a confirmation of receipt. The confirmation of receipt states the date on which the IND received your notice of objection. It is also included in the acknowledgment of receipt what time the IND takes a decision.
The IND checks whether your notice of objection is complete. Are documents missing, or are documents incorrect? Then the IND will send you a letter. This letter states which documents you or your lawyer must send. Do this within 2 weeks.
3. Decision
The IND will review your objection and make a decision.
Objection founded
If the IND decides that your objection is well-founded, you will receive a positive decision on your application. This means that you will still get the visa.
Objection unfounded
If the IND decides that your objection is unfounded, the objection will be rejected. This rejection is stated in an official letter (decision) from the IND. Do you disagree? Then you can as a profession set in court.
To court
You have a negative decision on your appeal. You can then appeal to the court.
