Liability when providing accommodation with a Schengen visa
When someone from abroad comes to the Netherlands with a Schengen visa and stays with you (you are the accommodation provider/guarantor), you are liable for your guest. If he or she causes damage, this could be recovered from you. That is why it is important that you have taken out or are still taking out Liability Insurance for Private Individuals. A Liability Insurance for Private Individuals (AVP for short) also covers liability for accommodation.
Liability Insurance for Private Individuals (AVP)
Private Liability Insurance is non-life insurance that protects the insured against the risks of liability in his private capacity. The AVP provides cover against all claims for which the insured is legally liable, unless the event causing the damage is specifically excluded.
The insurer usually offers a choice of single or family cover. The circle of insured persons depends on the cover chosen.
The following persons are insured under the single persons cover:
- The policyholder.
- Lodges, insofar as they are not insured themselves.
- Domestic staff, insofar as the liability is directly related to the work.
In the family cover, in addition to the persons mentioned in the single person cover, the following are insured:
- Husband/wife/registered partner;
- The persons living with him/her as a family, as well as their minor children;
- Their adult, unmarried children, living at home or living away for study.
- Living-in (grand-in-law) parents, relatives by blood and marriage.
Almost every Dutch person has an AVP insurance, if that is also the case in your case, you do not have to do anything. If this is not the case and you have a guest come over from abroad who is staying with you (and for whom you possibly guarantee a visa) then it is advisable to take out Liability Insurance for Private Individuals.
